1 Our Principles

The protection of your personal data is a genuine concern for us. We always process your data in accordance with the strict requirements of the General Data Protection Regulation (GDPR) and applicable national data protection laws. This happens whenever it is necessary for the trusting fulfillment of your stay, legal requirements, or to provide our services.

2 Hosting and Server Log Files

Every time you visit our website, our system automatically collects technical data (so-called server log files). This includes your IP address, browser type and version, the operating system used, the previously visited website (referrer URL), as well as the date and time of your request.

These data are technically necessary to display our website correctly and securely. The storage is based on our legitimate interest in the stability, security, and functionality of our website (Art. 6 (1) lit. f GDPR).

3 Your Booking with Us

To process your reservation smoothly and maintain our booking calendar, we use secure booking and management systems. When you make a booking, we collect the necessary information (such as name, address, email address, and travel dates) exclusively for the proper execution of your accommodation contract. The legal basis for this data processing is the performance of a contract (Art. 6 (1) lit. b GDPR).

To keep availability and prices up to date on portals (such as Google Vacation Rentals, Airbnb, Booking.com), we use the Smoobu Channel Manager. Here, only availability and pricing data are synchronized in real-time. A transfer of your personal guest data to these portals does not take place.

4 Payment Processing

To process your payment, we use the payment service provider Stripe Payments Europe, Ltd. The data necessary for the payment (including name, email address, and payment information) are transmitted directly to Stripe. This is done to fulfill our contract (Art. 6 (1) lit. b GDPR).

Stripe may also process data in the US. However, this data transfer is legally secured and legitimized by the EU-US Adequacy Decision (Data Privacy Framework) as well as by Standard Contractual Clauses of the EU Commission concluded by Stripe. 4a Smoobu Booking System

For booking processing, calendar management, and guest communication, we use the Property Management System (PMS) Smoobu operated by Smoobu GmbH, Pappelallee 78/79, 10437 Berlin. Smoobu serves as the central system for managing and automating our booking processes.

As part of the booking process, we transmit personal data to Smoobu such as name, email address, phone number, booking data (check-in, check-out, number of persons), and payment information. These data are used exclusively for the fulfillment of the accommodation contract and to support our service offerings.

Smoobu may process data in the US. The use of Smoobu is legally secured through Standard Contractual Clauses of the EU Commission. Further information can be found in Smoobu's privacy policy.

5 Tourist Tax (Municipality of Laboe)

As your host, we are obliged by the local tourist tax statutes and the municipal tax act to collect and remit the tourist tax for the municipality of Ostseebad Laboe. For this purpose, we transmit the required registration data (first name, last name, duration of stay, and the number of accompanying persons) to the municipal tourism service so that your OstseeCards can be issued smoothly. The processing takes place to fulfill a legal obligation (Art. 6 (1) lit. c GDPR).

6 On-Site Support and Housekeeping

To ensure everything is perfectly prepared for your arrival, we confidentially pass on the information necessary to coordinate final cleaning, key handover, and laundry provision (name of the main guest, duration of stay, and number of people) to our local partner property management (Hotelgesellschaft Fördeblick GbR, Laboe). This serves the optimal fulfillment of the contract and is based on our legitimate interest in a smooth on-site guest service (Art. 6 (1) lit. b and lit. f GDPR).

7 Legal Retention and Tax Office

Like any business, we are legally obliged to comply with certain tax and commercial retention periods (e.g., according to the German Fiscal Code or the Commercial Code). For this purpose, we securely store your invoice and booking receipts for the prescribed period (usually 10 years). The legal basis for this is the fulfillment of legal obligations (Art. 6 (1) lit. c GDPR).

8 Wi-Fi, Smart Home & Entertainment

For your comfort, we are happy to provide you with modern Wi-Fi access. Of course, we do not log or monitor your personal surfing behavior at any time. Our smart home applications (heating control, lighting) as well as our entertainment devices (TV, Xbox) are exclusively for your convenience, safety, and a pleasant room climate. No personalized behavioral profiles are created. This data processing is based on our legitimate interest in offering you a modern and comfortable accommodation (Art. 6 (1) lit. f GDPR).

In your own interest, please remember to log out of your own accounts (e.g., Netflix) upon departure.

9 Cookies

We use exclusively technically necessary session cookies on our website, which are required for the function of the site (e.g., security and navigation). There is no tracking or profiling of your user behavior. The use of these strictly necessary cookies is based on the German Telecommunications and Telemedia Data Protection Act (TDDDG) in conjunction with our legitimate interest in a functioning website (Art. 6 (1) lit. f GDPR). A separate cookie banner is therefore not required.

10 Your Rights

Transparency means that you always have control over your data. According to applicable data protection laws, you have the following rights:

  • Information: You can request free information about your stored data at any time (Art. 15 GDPR).
  • Rectification: You have the right to have incorrect or incomplete data corrected (Art. 16 GDPR).
  • Erasure: You can request the deletion of your data, provided no legal retention periods (e.g., from the tax office) speak against it (Art. 17 GDPR).
  • Restriction: Under certain conditions, you can request that we restrict the processing of your data (Art. 18 GDPR).
  • Data Portability: You have the right to receive your data in a structured, commonly used, and machine-readable format (Art. 20 GDPR).
  • Objection: You can object at any time to data processing based on our legitimate interest (Art. 6 (1) lit. f GDPR) (Art. 21 GDPR).
  • Right to Complain: If you believe that we are making mistakes in handling your data, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR).

11 Legally Binding Language

In the event of any discrepancies, contradictions, or doubts regarding the interpretation between the German original and this translated version, the original German version shall exclusively prevail and be legally binding.
